Terms of Service

These Terms of Service ("Terms") constitute a legally binding agreement between you ("you", "your", "User") and EmailSignatures.au ("we", "us", "our", "the Service"). By accessing our website, creating an account, browsing templates, or making a purchase, you agree to be bound by these Terms in full. If you do not agree, you must discontinue use of the Service immediately.
1. Definitions
- "Service" means the EmailSignatures.au website, email signature generator, template library, account system, team dashboard, and all related tools and integrations.
- "Signature" means the custom HTML email signature generated by our Service based on your selected template and provided details.
- "Template" means any email signature design available through our platform, across all pricing tiers.
- "Account" means a registered user account created via Google Sign-In or other authentication methods we offer.
- "Team Bundle" means a discounted multi-signature purchase that generates individual redemption codes for team members.
- "Redemption Code" means a unique code (e.g. BDL-XXXX) issued as part of a Team Bundle that entitles the holder to one signature.
2. Service Description
EmailSignatures.au provides an automated email signature generation platform. The Service allows you to:
- Browse and preview over 220 professionally designed email signature templates across three pricing tiers (Essential, Professional, and Executive).
- Customise a template with your personal or business details, including name, job title, contact information, company logo, social media links, and other fields supported by the chosen template.
- Purchase and receive a fully rendered HTML email signature delivered to your nominated email address.
- Optionally create an account to manage your signatures, view order history, and access your team dashboard.
- Optionally install your signature directly into Gmail or Microsoft Outlook via our one-click integration (requires authorisation of the relevant Google or Microsoft account).
- Purchase Team Bundles for multiple employees or team members at discounted rates.
3. Eligibility
You must be at least 18 years of age, or the age of legal majority in your jurisdiction, to use the Service or make a purchase. By using the Service, you represent and warrant that you meet this requirement. If you are using the Service on behalf of a business or organisation, you represent that you have authority to bind that entity to these Terms.
4. Account Registration & Security
- Account creation is optional for individual purchases but required for accessing certain features such as order history, saved signatures, and the team dashboard.
- Accounts are created via Google Sign-In. By signing in, you authorise us to receive your name and email address from Google for the purpose of creating and managing your account.
- You are responsible for maintaining the security of your account. Do not share your login credentials or allow others to access your account.
- We may require email verification before granting access to certain features. You agree to provide a valid email address and to complete the verification process when prompted.
- We reserve the right to suspend or terminate any account that we reasonably believe has been compromised, is being used fraudulently, or is in violation of these Terms.
- You may request deletion of your account and associated personal data at any time by contacting us at [email protected].
5. Pricing, Payment & Billing
- All prices are listed in Australian Dollars (AUD) and include GST where applicable.
- Current pricing tiers are: Essential ($29 AUD), Professional ($49 AUD), and Executive ($79 AUD). Pricing is subject to change at our discretion, but changes will not affect orders already placed or active redemption codes.
- All purchases are one-time payments. There are no subscriptions, recurring fees, or hidden charges.
- Payments are processed securely via Stripe. We do not store, process, or have access to your full credit card details. All payment data is handled directly by Stripe in accordance with PCI-DSS Level 1 compliance standards.
- Discount codes may be offered from time to time at our discretion. Discount codes are subject to their own terms (e.g. expiry dates, usage limits, eligible tiers) and may be revoked or modified at any time.
- We are not responsible for any additional fees charged by your bank or payment provider (e.g. currency conversion fees, international transaction fees).
6. Team Bundles & Volume Pricing
- Team Bundles allow businesses to purchase multiple signatures at discounted rates:
- 3–9 signatures: 20% discount per signature
- 10–24 signatures: 30% discount per signature
- 25+ signatures: Custom enterprise pricing (contact us)
- Upon purchase of a Team Bundle, you will receive individual Redemption Codes for each signature. Each code may be redeemed once by the intended team member.
- Redemption Codes are non-transferable outside your organisation, may not be resold, and have no cash value.
- The purchaser of a Team Bundle is responsible for distributing Redemption Codes to their team members. We are not responsible for lost or misused codes.
- Team Bundle purchases are managed through the team dashboard, accessible via your Account.
7. Delivery
- Your email signature is generated automatically and delivered to the email address you provide during checkout. Delivery is typically instant.
- If you do not receive your signature within 15 minutes, check your spam/junk folder. If it is not there, contact us at [email protected] and we will re-send it promptly.
- Delivery is also available through your Account dashboard, where you can view and re-download your purchased signatures at any time.
- We are not responsible for delivery failures caused by incorrect email addresses provided by you, or by email filtering/blocking by your email provider.
8. Gmail & Outlook Integration
- We offer optional one-click signature installation for Gmail (via Google OAuth 2.0) and Microsoft Outlook (via Microsoft OAuth).
- Using these integrations requires you to authorise our application to access your email account for the sole purpose of setting your email signature. We do not read, store, or access any of your emails, contacts, or other account data.
- You may revoke this authorisation at any time through your Google or Microsoft account settings.
- These integrations are provided as a convenience. We do not guarantee compatibility with all versions of Gmail or Outlook, and we are not responsible for any changes made by Google or Microsoft that may affect the integration.
9. Refund Policy
- We offer a 7-day satisfaction guarantee. If you are not satisfied with your email signature for any reason, contact us within 7 days of purchase at [email protected] and we will issue a full refund — no questions asked.
- Refunds are processed back to the original payment method via Stripe. Processing times depend on your bank and may take 5–10 business days to appear on your statement.
- After the 7-day period, refunds are at our sole discretion and will only be considered in exceptional circumstances (e.g. duplicate charges, technical errors preventing delivery).
- Refund requests for Team Bundles will be handled on a case-by-case basis. Partial refunds may be issued for unredeemed codes only.
- This refund policy does not limit or exclude any rights you have under Australian Consumer Law (see Section 15).
10. Intellectual Property
- All template designs, website content, source code, branding, graphics, and documentation are the exclusive intellectual property of EmailSignatures.au and are protected by Australian and international copyright law.
- Upon purchase, you receive a non-exclusive, non-transferable, perpetual licence to use the generated HTML email signature for your personal or internal business communications.
- This licence permits you to:
- Use the signature in your email client(s) for sending emails
- Make minor modifications to the signature content (e.g. updating your phone number or job title)
- This licence does not permit you to:
- Resell, sublicense, redistribute, or offer our templates or generated signatures as part of a competing service
- Extract, decompile, or reverse-engineer our template code for the purpose of creating derivative templates
- Remove or alter any attribution, branding, or watermarks included in free or preview versions
- Claim ownership of our template designs or present them as your own original work
- We reserve all rights not expressly granted in these Terms.
11. User Content & Responsibilities
- You are solely responsible for the accuracy, legality, and appropriateness of all content you enter into your email signature, including but not limited to: names, job titles, company names, phone numbers, email addresses, website URLs, social media links, images, and logos.
- You represent and warrant that you have the right to use any logos, images, or trademarks you upload or include in your signature.
- We do not review, verify, or endorse user-provided content and are not responsible for any errors, omissions, or legal issues arising from your content.
- You agree not to include content that is defamatory, obscene, fraudulent, misleading, or otherwise unlawful in your email signature.
12. Acceptable Use
You agree not to:
- Use the Service for any unlawful, fraudulent, or malicious purpose
- Attempt to reverse-engineer, decompile, disassemble, or otherwise extract the source code of our templates, website, or any related software
- Interfere with or disrupt the proper functioning of our website, servers, or infrastructure
- Use automated tools, bots, scrapers, or spiders to access, crawl, or index our Service without our express written permission
- Attempt to gain unauthorised access to other users' accounts, our admin systems, or any part of our infrastructure
- Circumvent, disable, or otherwise interfere with any security features, rate limits, or access controls
- Use the Service to send spam, phishing emails, or other unsolicited bulk communications
- Impersonate any person or entity, or falsely claim an affiliation with any person or entity
- Violate any applicable local, state, national, or international law or regulation
Violation of this section may result in immediate account suspension or termination, at our sole discretion, without prior notice or refund.
13. Mailing List & Communications
- You may optionally subscribe to our mailing list to receive product updates, new template announcements, and promotional offers.
- Subscription is entirely voluntary and not required to use the Service.
- Every marketing email we send includes a one-click unsubscribe link. You may also unsubscribe by contacting us directly.
- We may send transactional emails relating to your purchases, account activity, or service notices regardless of your mailing list subscription status. These are not marketing communications and are necessary for the operation of the Service.
14. Limitation of Liability
- To the maximum extent permitted by Australian law, EmailSignatures.au, its owners, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, business, or goodwill, arising from or in connection with your use of the Service.
- Our total aggregate liability for any claim arising from or related to the Service is limited to the amount you actually paid to us for the specific signature or service giving rise to the claim.
- We do not warrant that the Service will be available at all times, error-free, or free from security vulnerabilities. The Service is provided on an "as is" and "as available" basis.
- We are not liable for any issues arising from third-party services, including but not limited to Stripe payment processing, Google or Microsoft OAuth integrations, email delivery providers, or your email client's rendering of the signature HTML.
15. Australian Consumer Law
Nothing in these Terms is intended to exclude, restrict, or modify any rights or remedies you may have under the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010 (Cth)). Our services come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the services remedied if they fail to be of acceptable quality and the failure does not amount to a major failure.
16. Indemnification
You agree to indemnify, defend, and hold harmless EmailSignatures.au, its owners, employees, and affiliates from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable legal fees) arising from or related to: (a) your use of the Service; (b) your violation of these Terms; (c) your violation of any third party's rights, including intellectual property rights; or (d) any content you provide through the Service.
17. Privacy
Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal information. By using the Service, you consent to the practices described in our Privacy Policy. Our Privacy Policy is incorporated into these Terms by reference.
18. Termination
- You may stop using the Service at any time. You may request account deletion by contacting us at [email protected].
- We may suspend or terminate your account or access to the Service at any time, with or without cause, including but not limited to: violation of these Terms, suspected fraud, or abuse of the Service.
- Upon termination, your right to use the Service ceases immediately. However, any signatures you have already purchased and received remain licensed to you in accordance with Section 10.
- Sections 10 (Intellectual Property), 14 (Limitation of Liability), 16 (Indemnification), and 20 (Governing Law) survive termination of these Terms.
19. Changes to These Terms
We reserve the right to update or modify these Terms at any time. When we make changes, we will update the "Last updated" date at the top of this page. If we make material changes, we may notify you via email or a prominent notice on our website. Your continued use of the Service after any changes constitutes your acceptance of the revised Terms. If you do not agree to the updated Terms, you must discontinue use of the Service.
20. Governing Law & Dispute Resolution
- These Terms are governed by and construed in accordance with the laws of the State of New South Wales, Australia, without regard to conflict of law principles.
- Any disputes arising from or in connection with these Terms or your use of the Service shall be subject to the exclusive jurisdiction of the courts of New South Wales, Australia.
- Before initiating legal proceedings, you agree to first attempt to resolve any dispute informally by contacting us at [email protected]. We will endeavour to resolve any complaints or disputes within 30 days.
21. Severability
If any provision of these Terms is found to be invalid, unlawful, or unenforceable by a court of competent jurisdiction, that provision shall be severed from these Terms and the remaining provisions shall continue in full force and effect.
22. Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and EmailSignatures.au regarding your use of the Service. These Terms supersede all prior agreements, representations, and understandings, whether written or oral.
